[TRANS] C-JeS Guidelines To Fan Support For JYJ


Hello, this is C-JeS Entertainment.

We, as the company in charge of management for JYJ, post this notice to inform you of the guidelines that we have set on fan support that will come into effect on the 1st of January, 2012.

Till now, we have viewed and considered the events and sale of goods from fansites as an autonomous domain for fans. However, as several instances have come to our attention in which the artistes’ names (Namensrecht)* (See T/N below) were used without prior consultation and profit was created for personal gains, it has become inevitable for us, as JYJ’s management company, to set guidelines on fan support and we ask you to please read what is stated below.

We are taking into special consideration the problem of fan goods being altered to become an entrepreneurial source of high profit, the fact that fan goods with images of the artistes on them are being sold at exorbitant prices by illegal merchants as third and fourth powers, as well as the fact that the industrialization of fan goods leads to problems in the production of official goods that provide the artistes with a fair profit. Also, as fan goods can have an influence on the breach clause in contracts for official MD goods, which would lead to placing the artistes at a disadvantage, we are planning to keep a strict supervision on the sales of goods.

1) We prohibit the use of JYJ’s name rights and portrait rights (photos and images etc) in the production of goods.
2) If 100 or more people are set to gather for a JYJ (Jaejoong, Yoochun, Junsu) fan event, the fansite in charge will share the contents of the event with C-JeS in advance and if there is an entry fee, the fansite must first receive permission from C-JeS after a consultation of the event’s budget breakdown. (However, this does not apply to events with less than 100 people attending or events that do not require an entry fee.)
3) Even activities such as fan support or donation drives that involve an entry fee or money being collected must be notified to C-JeS in advance.

However, we believe that these guidelines are more for fans to follow to become more self-aware and establish a proper fan culture than a warning from the management agency. We ask that all of you make the right judgment on this issue.

T/N: In the case of JYJ, as they are celebrities, I’m sure ‘Namensrecht’ also covers the use of their signatures. I’ve seen a fair share of people selling CDs, DVDs and photobooks online that have ‘personal signatures from the members’. One can’t help but wonder how they got signatures from so many different singers for so many different goods.
